TERMS OF SERVICE
Effective Date: These Terms are effective as to each user on the date that user first accesses, registers for, purchases access to, clicks to accept, or otherwise agrees to these Terms, whichever occurs first. If RV MarketIQ posts revised Terms, the revised Terms are effective as to existing users when accepted, when the user purchases additional access, or when the revised Terms otherwise become effective as stated in the update notice.

These Terms of Service (the "Terms") govern your access to and use of RV MarketIQ, including RVMarketIQ.com, any related mobile or web applications, dashboards, artificial intelligence features, Pay-As-You-Go Credits, Premium Daily Quota, listings, lead forms, dealer tools, valuation tools, towing tools, import tools, alert tools, and related services (collectively, the "Platform"). The Platform is operated by Hollingshead Holdings, LLC, a Missouri limited liability company doing business as RV MarketIQ ("RV MarketIQ," "we," "us," or "our").
By clicking "I Agree," checking an acceptance box, creating an account, purchasing access, purchasing or using DealGuard Credits, using a Premium Daily Quota, submitting a listing, submitting an inquiry, using DealGuard, using the Negotiation Agent, using the Tow Capacity Estimator, importing or analyzing a URL, uploading content, opting into data use, or otherwise accessing or using the Platform after being presented with these Terms, you agree to these Terms.
If you do not agree to these Terms, do not access or use the Platform.
IMPORTANT NOTICES
A. No Automatic Renewal for Consumer Access Plans or DealGuard Credit Packs. Consumer Basic and Premium access plans are fixed-term prepaid access plans unless a checkout screen expressly states otherwise and obtains legally sufficient affirmative consent to automatic renewal. DealGuard Credit Packs are one-time purchases and do not automatically renew. RV MarketIQ will not charge you for an additional consumer access term or additional DealGuard Credits unless you affirmatively purchase them or separately consent to automatic-renewal terms.
B. No Arbitration; Missouri Forum. These Terms do not require arbitration. Subject to any nonwaivable rights and subject-matter jurisdiction limits, disputes must be filed in the United States District Court for the Eastern District of Missouri, Eastern Division, if federal subject-matter jurisdiction exists; otherwise, disputes must be filed in the Circuit Court of St. Louis County, Missouri.
C. Class Action Waiver and Jury Trial Waiver. To the maximum extent permitted by law, these Terms contain a standalone class action waiver and a waiver of jury trial. These provisions do not waive nonwaivable statutory rights or remedies and do not apply where prohibited by applicable law.
D. RV MarketIQ Is Not a Seller, Dealer, Auctioneer, Broker, Appraiser, Inspection Company, Law Firm, Financial Advisor, Insurance Advisor, Towing-Safety Professional, Money Transmitter, Bank, Escrow Company, or Payment Intermediary. RV MarketIQ is an information, analytics, and marketplace-intelligence platform. RV MarketIQ does not own, sell, inspect, certify, finance, warrant, appraise, transport, tow, broker, escrow, hold funds for third parties, or transmit money for any RV, vehicle, trailer, part, service, or transaction unless expressly stated in a separate written agreement signed by RV MarketIQ.
E. AI Outputs Are Probabilistic and May Be Wrong. DealGuard risk labels, scam analysis, negotiation suggestions, generated messages, towing estimates, valuation estimates, duplicate-detection outputs, imported-listing outputs, and other automated or AI-assisted outputs are informational tools only. They may be inaccurate, incomplete, stale, biased, misleading, unsafe, or unsuitable for your circumstances. You must independently verify all information before relying on it.
F. Towing Decisions Can Cause Physical Injury, Death, and Property Damage. The Tow Capacity Estimator is not safety advice and is not a substitute for your vehicle owner's manual, manufacturer labels, payload sticker, hitch ratings, tire ratings, brake ratings, dealer guidance, manufacturer guidance, professional inspection, or your own judgment. You are solely responsible for towing decisions.
G. Express Negligence Release. To the maximum extent permitted by law, you release RV MarketIQ and its released parties from claims arising from your use of the Platform, including claims arising from the NEGLIGENCE, FAULT, OR CARELESSNESS of RV MarketIQ or released parties, subject to the exceptions and nonwaivable-rights savings language in these Terms.
H. No Attorney-Client Relationship. RV MarketIQ does not provide legal services or legal advice. No attorney-client relationship, prospective-client relationship, engagement, retainer, fiduciary relationship, or confidential attorney communication is created by using the Platform, even if an owner, employee, contractor, advisor, or operator of RV MarketIQ is a licensed attorney.
I. Expiration May Affect Saved Data. If your access term expires and you do not purchase additional access before expiration, you may lose access to saved searches, DealGuard threads, Negotiation Agent history, offer notes, Tow Capacity Estimator data, imported listing drafts, alerts, watchlists, and other saved data. See Sections 6 and 22.
J. Optional AI Training Consent; Operational Fraud-Pattern Processing. RV MarketIQ may use data to operate, secure, debug, evaluate, and improve the Platform, including operational fraud-pattern retrieval, confirmed-scam feedback processing, summaries, tags, signals, and embeddings used to improve DealGuard and related safety features. RV MarketIQ will not intentionally use identifiable DealGuard submissions to train or fine-tune generative AI models unless you affirmatively opt in or another legally sufficient consent mechanism applies.
K. DealGuard Credits and Premium Daily Quota. DealGuard Credits are closed-loop, non-monetary, prepaid digital service units redeemable only for eligible DealGuard services on RVMarketIQ.com. They are not money, currency, bank deposits, gift cards, gift certificates, stored value, payment instruments, or cash equivalents. They are non-refundable, non-transferable, not redeemable for cash, and expire no earlier than five (5) years after purchase unless applicable law requires a longer period or different treatment. Premium Daily Quota is a separate use-it-or-lose-it daily feature entitlement, not a purchased credit balance.
L. Taxes, Unclaimed Property, and Required Disclosures. Taxes, if any, are calculated based on billing information and applicable law. Unused DealGuard Credits may be subject to state unclaimed-property, escheat, abandoned-property, or similar laws. Credit-pack checkout screens and account screens may include additional required disclosures, acknowledgment checkboxes, balances, expiration dates, and notices.
1. Acceptance of Terms
1.1 Binding Agreement. These Terms are a legally binding agreement between you and RV MarketIQ. By clicking “I Agree,” checking an acceptance box, creating an account, purchasing access, submitting a form after being presented with these Terms, or otherwise using the Platform after being presented with these Terms, you affirmatively accept and agree to be bound by these Terms. RV MarketIQ may condition access to the Platform on an affirmative clickwrap, checkbox, checkout acknowledgment, or similar assent mechanism and may record your acceptance date, accepted version, account identifier, IP address, and related assent metadata. If you use the Platform on behalf of a business, dealership, law firm, partnership, organization, or other entity, you represent that you have authority to bind that entity, and “you” includes both you individually and that entity.
1.2 Related Policies. These Terms incorporate by reference RV MarketIQ’s Privacy Policy, any Dealer Terms, Community Guidelines, listing rules, checkout disclosures, AI feature disclosures, DMCA policy, optional AI-training consent notices, and any plan-specific terms displayed at checkout or in the Platform.
1.3 Order of Priority. If there is a conflict among documents, the following order controls unless a written agreement signed by RV MarketIQ states otherwise: (a) a signed written agreement with RV MarketIQ; (b) plan-specific checkout terms; (c) Dealer Terms or business-account addenda; (d) specific feature-level consent or disclosure screens; (e) these Terms; (f) the Privacy Policy; and (g) other Platform policies.
1.4 Changes to Platform. RV MarketIQ may add, remove, suspend, modify, restrict, rename, or discontinue any feature, plan, data source, model, algorithm, scoring method, listing source, integration, dashboard, import tool, AI provider, or user interface at any time, subject to applicable law and any nonwaivable rights you may have.
1.5 No Use if Barred. You may not use the Platform if you are prohibited from doing so under applicable law, these Terms, sanctions restrictions, export-control restrictions, or any prior suspension by RV MarketIQ.
1.6 Nonwaivable Rights. Nothing in these Terms is intended to waive rights or remedies that applicable law does not allow you to waive. Any waiver, disclaimer, limitation, release, venue provision, class waiver, jury waiver, fee provision, or other term applies only to the maximum extent permitted by law.
2. Definitions
For purposes of these Terms:
2.1 "Access Plan" means a paid or free right to access certain Platform features for a specified period, usage level, quota, or entitlement, including Basic, Premium, dealer, business, trial, beta, or other plans displayed by RV MarketIQ.
2.2 "AI Output" means any content, label, score, summary, estimate, draft message, recommendation, analysis, classification, explanation, transcription, extraction, or other output generated or assisted by artificial intelligence, machine learning, statistical models, rules-based systems, or automated systems.
2.3 "Basic Plan" means the fixed-term prepaid consumer access plan labeled Basic, or a substantially similar plan, as displayed at checkout.
2.4 "Buyer Inquiry" means a message, contact request, lead form submission, or other inquiry submitted by a prospective buyer through the Platform to a private seller, dealer, or listing contact.
2.5 "Consumer Access Plan" means a fixed-term prepaid plan purchased by an individual primarily for personal, family, or household RV shopping, valuation, scam-screening, negotiation, towing, or marketplace-intelligence purposes.
2.6 "Credit Balance" means the number of unused DealGuard Credits associated with your account as reflected in RV MarketIQ's systems, subject to verification, correction, expiration, chargeback reversal, fraud controls, unclaimed-property obligations, and applicable law.
2.7 "Credit Batch" means a group of DealGuard Credits purchased or issued at the same time and tracked with a common purchase date, source, price, and expiration date.
2.8 "Credit Pack" means a one-time purchase of a specified number of DealGuard Credits, such as a 25-credit, 60-credit, 150-credit, 400-credit, or other pack displayed at checkout.
2.9 "Dealer" means any person or entity using the Platform for business, commercial, dealership, broker, consignment, fleet, financing, service, or inventory-management purposes.
2.10 "DealGuard" means RV MarketIQ's scam-analysis, fraud-pattern detection, risk-labeling, deal-tracking, offer-tracking, negotiation-support, and related AI-assisted deal-intelligence features.
2.11 "DealGuard Credit" or "Credit" means a closed-loop, non-monetary, prepaid digital service unit issued by RV MarketIQ that may be redeemed only within the Platform for an Eligible DealGuard Analysis or other eligible DealGuard service expressly displayed by RV MarketIQ. DealGuard Credits are not money, currency, bank deposits, gift cards, gift certificates, stored value, payment instruments, negotiable instruments, securities, legal tender, or cash equivalents.
2.12 "De-identified Data" means data that RV MarketIQ has taken reasonable steps to remove, mask, aggregate, or otherwise process so that it is not reasonably capable of identifying a specific person or household, including by removing names, email addresses, phone numbers, postal addresses, account identifiers, payment identifiers, financial account numbers, license numbers, and other directly identifying information.
2.13 "Eligible DealGuard Analysis" means a DealGuard analysis, scan, review, or other unit of DealGuard usage that RV MarketIQ designates as eligible for consumption of a Premium Daily Quota or DealGuard Credit. RV MarketIQ may define, rename, combine, split, or modify eligible usage units prospectively.
2.14 "Identifiable Training Data" means Submitted Content or derived data that is used for model training or fine-tuning and that remains reasonably capable of identifying a specific person, account, household, device, transaction, seller, buyer, or other third party.
2.15 "Listing" means any RV, vehicle, trailer, auction, classified, dealer, private-seller, or related listing displayed, imported, analyzed, archived, scraped, aggregated, indexed, stored, or otherwise processed through the Platform.
2.16 "MarketIQ Value" means an algorithmic pricing estimate, range, benchmark, comparable-based estimate, confidence label, or related valuation output displayed by the Platform.
2.17 "Negotiation Agent" means RV MarketIQ's generative AI-assisted negotiation tool, including any GPT-powered features that generate negotiation strategy, suggested offers, counteroffer ranges, talking points, or draft messages.
2.18 "Optional Training Consent" means a separate checkbox, toggle, account setting, click-through, or other affirmative consent mechanism by which a user authorizes RV MarketIQ to use specified Submitted Content or related data for model training, fine-tuning, evaluation, or similar AI-improvement activities beyond ordinary operation of the Platform.
2.19 "Premium Daily Quota" means a non-monetary, non-accumulating, use-it-or-lose-it daily entitlement included with a Premium Plan, if offered, that allows a specified number of Eligible DealGuard Analyses during each UTC calendar day.
2.20 "Premium Plan" means the fixed-term prepaid consumer access plan labeled Premium, or a substantially similar plan, as displayed at checkout.
2.21 "Seller" means a private seller, dealer, auction platform, marketplace, listing source, broker, consignor, or other third party that offers, displays, owns, controls, or claims authority over a Listing.
2.22 "Submitted Content" means any content, data, file, URL, message, conversation, image, screenshot, audio recording, PDF, transcript, Listing content, feedback, profile data, inquiry, note, or other material you submit, upload, paste, import, transmit, or otherwise provide to the Platform.
2.23 "Tow Capacity Estimator" means RV MarketIQ's tool or feature that estimates, calculates, compares, or explains towing-related information, including tow rating, payload, tongue weight, gross vehicle weight, gross combined weight, hitch requirements, or compatibility between a tow vehicle and an RV or trailer.
2.24 "User" means any visitor, registered account holder, buyer, seller, dealer, business user, administrator, or other person accessing or using the Platform.
3. Eligibility; Minimum Age; Geographic Scope
3.1 Minimum Age. You must be at least eighteen (18) years old to use the Platform. The Platform is not intended for children under 13 and is not directed to minors.
3.2 Authority. If you use the Platform on behalf of an entity, you represent and warrant that you are authorized to bind that entity to these Terms.
3.3 Consumer and Business Use. Some features are intended for consumers shopping for RVs. Other features are intended for Dealers, businesses, or professional users. You must not misrepresent your status, role, authority, identity, dealership affiliation, ownership of inventory, buyer status, seller status, or eligibility for any plan.
3.4 U.S.-Focused Platform. RV MarketIQ is designed primarily for users located in the United States and for RVs, tow vehicles, sellers, dealers, and listings in the United States. If you access the Platform from outside the United States, you do so at your own risk and are responsible for compliance with local law.
3.5 State-Specific Availability. RV MarketIQ may restrict, suspend, modify, or condition access to the Platform, particular features, particular Access Plans, or particular data uses in any state or jurisdiction where RV MarketIQ determines that legal, privacy, consumer-protection, tax, dealer, advertising, AI, or operational obligations are disproportionate or unclear.
3.6 California and Other State Rights. California and other state residents may have nonwaivable rights under state consumer-protection, privacy, automatic-renewal, data-security, or other laws. Nothing in these Terms limits such nonwaivable rights.
4. Account Registration and Security
4.1 Accounts. Certain features require an account. Account creation and authentication may be handled through third-party authentication providers, including Clerk or other providers selected by RV MarketIQ.
4.2 Accurate Information. You must provide accurate, current, and complete account information and keep it updated. You may not impersonate another person or create an account using false, misleading, stolen, or unauthorized information.
4.3 Account Security. You are responsible for maintaining the confidentiality of your credentials, devices, authentication methods, and account access. You are responsible for all activity under your account unless caused solely by RV MarketIQ’s own unauthorized act.
4.4 OAuth and Third-Party Sign-In. If you use Google, Apple, Clerk, or another third-party sign-in method, your use of that authentication method is also governed by that provider’s terms and privacy policy.
4.5 Unauthorized Access. You must promptly notify RV MarketIQ at support@RVMarketIQ.com if you believe your account has been compromised or used without authorization.
4.6 Account Sharing. Unless RV MarketIQ expressly authorizes multi-user access for a business account, you may not share login credentials, resell access, pool accounts, or allow others to use your account.
5. Overview of the Platform; User Acknowledgments
5.1 Information and Intelligence Platform. RV MarketIQ provides marketplace intelligence, listing aggregation, search, data analysis, scam-risk screening, negotiation assistance, towing-related estimates, valuation estimates, alerts, watchlists, import tools, and related features.
5.2 No Transaction Party. RV MarketIQ is not a party to transactions between buyers, sellers, dealers, auction platforms, finance providers, transport providers, inspection providers, warranty providers, or other third parties.
5.3 No Endorsement. Display of a Listing, Dealer, Seller, data source, pricing estimate, risk label, duplicate match, alert, or AI Output does not mean that RV MarketIQ endorses, verifies, sponsors, recommends, guarantees, or certifies it.
5.4 Feature Availability. Features may vary by plan, geography, account status, inventory source, listing type, data-source availability, and technical limitations. RV MarketIQ may test, modify, beta-test, restrict, or discontinue features at any time.
5.5 Reasonable-Consumer Acknowledgments. By using the Platform, you acknowledge that: (a) RV shopping involves risk; (b) RV MarketIQ provides information and tools, not guarantees; (c) AI Outputs and data outputs may be wrong; (d) you must read feature disclosures, plan terms, checkout terms, warning labels, and original source materials; (e) you must independently verify material information before acting; and (f) no reasonable user should treat any Platform output as a promise, appraisal, safety certification, fraud finding, legal opinion, professional advice, or transaction guarantee.
6. Fixed-Term Access Plans; Payment; Expiration
6.1 Consumer Plans Are Fixed-Term Prepaid Access. Unless checkout expressly states otherwise and obtains your affirmative consent to automatic renewal, RV MarketIQ's consumer Basic and Premium plans are fixed-term prepaid access plans. They provide access for the period purchased and do not automatically renew.
6.2 No Automatic Renewal for Basic and Premium Consumer Plans Unless Expressly Disclosed. RV MarketIQ will not automatically charge you for a new Basic or Premium consumer access term unless RV MarketIQ separately presents automatic-renewal terms and obtains your express affirmative consent in a manner required by applicable law.
6.3 Plan Terms, Pricing, Features, Quotas, and Credits. Prices, plan names, plan lengths, included features, usage limits, Premium Daily Quota, Credit Packs, discounts, and other entitlements are displayed at checkout or in the Platform. The price, access period, included features, usage limits, quotas, and credit terms displayed and accepted at checkout control that purchase. RV MarketIQ may change prices, discounts, plan names, plan lengths, included features, usage limits, quotas, Credit Packs, and promotional offers prospectively at any time before purchase. Price changes do not alter the price or access period for a fixed-term Consumer Access Plan or Credit Pack you already purchased, unless required by law or agreed by you.
6.4 Multi-Month Discounts and Quantity Pricing. RV MarketIQ may offer discounted two-month, three-month, or other fixed-term access plans. RV MarketIQ may also offer Credit Packs with different effective per-credit rates based on quantity. Discount descriptions and quantity-pricing descriptions are based on the price displayed at checkout and are subject to change before purchase. A discount or quantity price is not a guarantee that the same price, comparison, pack size, or offer will be available later.
6.5 Checkout Controls. If a checkout screen, order confirmation, credit-purchase disclosure, quota disclosure, or plan-specific disclosure displays terms different from these general Terms, the checkout terms control for that purchase to the extent of the conflict, except that checkout terms may not waive nonwaivable rights, impose automatic renewal unless legally sufficient automatic-renewal consent is separately obtained, or shorten any nonwaivable statutory rights.
6.6 Expiration of Access. Your paid access begins when RV MarketIQ or its payment processor confirms your purchase, unless checkout states a different start date. Your paid access ends at the expiration of the fixed term purchased unless you purchase additional access.
6.7 Expiration Reminder. RV MarketIQ will use commercially reasonable efforts to send a reminder approximately seven (7) days before a paid access term expires. The reminder may warn that failure to purchase additional access before expiration may result in loss of access to saved data. Failure to receive a reminder, including because of spam filtering, incorrect email address, email delivery failure, user opt-out, or technical issue, does not extend your access term and does not obligate RV MarketIQ to preserve data beyond the retention period stated in these Terms or the Privacy Policy.
6.8 Data-Loss Warning at Expiration. If your access term expires and you do not purchase additional access before expiration, you may lose access to saved searches, watchlists, alerts, DealGuard threads, risk analyses, risk override logs, negotiation history, generated draft messages, offer notes, Tow Capacity Estimator data, tow profiles, imported listing drafts, listing snapshots, saved valuations, and other saved data. RV MarketIQ may delete, anonymize, archive, restrict, or make inaccessible expired-plan data after the applicable retention period. The default retention period for user-specific saved data is thirty (30) days following expiration of your paid access term, unless the Privacy Policy, checkout terms, legal holds, security needs, or operational requirements state otherwise.
6.9 Reactivation. If you purchase additional access after your prior access term expires, RV MarketIQ may restore access to data that remains stored and associated with your account. RV MarketIQ does not guarantee that expired, archived, deleted, anonymized, or otherwise unavailable data can be restored.
6.10 Free Access. RV MarketIQ may offer free features. Free access may be limited, changed, suspended, or discontinued at any time. Free access does not include DealGuard unless RV MarketIQ expressly offers limited free DealGuard access, grants a promotional credit, or permits the user to purchase and use DealGuard Credits under Section 6A. Free access may not include the Negotiation Agent, Tow Capacity Estimator history, saved history, advanced alerts, or other premium features.
6.11 Basic Plan and DealGuard. Unless checkout states otherwise, the Basic Plan does not include a Premium Daily Quota or included DealGuard access. Basic Plan users may purchase DealGuard Credits if RV MarketIQ makes Credit Packs available to that user, subject to Section 6A, checkout disclosures, account status, geographic availability, fraud controls, and applicable law.
6.12 Premium Plan and DealGuard. If offered, the Premium Plan may include a Premium Daily Quota for Eligible DealGuard Analyses. Premium users may also purchase DealGuard Credits for over-quota usage or other eligible usage. Premium Daily Quota and DealGuard Credits are governed by Section 6A.
6.13 Business and Dealer Plans. Dealer, business, enterprise, legal-intelligence, or other professional plans may be fixed-term, month-to-month, annual, recurring, invoice-based, usage-based, credit-based, quota-based, or subject to separate written terms. If any Dealer or business plan automatically renews, the applicable checkout, order form, or Dealer Terms must state the automatic-renewal terms and obtain any legally required consent.
6.14 Payment Processor. Payments may be processed by Stripe or another third-party payment processor. You authorize RV MarketIQ and its payment processor to charge your selected payment method for amounts shown at checkout, including applicable taxes and fees. Payment information is handled by the payment processor, and your use of payment services may be subject to the processor's terms.
6.15 Taxes. You are responsible for taxes, duties, levies, and similar charges associated with your purchase, except taxes based on RV MarketIQ's net income. Taxes, if any, may be calculated based on your billing address, account address, purchase location, or other legally relevant information. RV MarketIQ does not provide tax advice.
6.16 Failed Payments. If a payment is declined, reversed, disputed, charged back, or otherwise not completed, RV MarketIQ may deny, suspend, or terminate access to paid features, reverse or remove access entitlements, reverse or remove DealGuard Credits, or take other action permitted by these Terms and applicable law.
6.17 Refund Policy. Unless checkout states otherwise or applicable law requires otherwise, fees for fixed-term consumer access plans and DealGuard Credit Packs are nonrefundable once access begins or Credits are delivered to your account. RV MarketIQ may, in its discretion, issue refunds, credits, extensions, or replacement Credits for billing errors, duplicate payments, technical failures, unauthorized transactions, or other circumstances. Any voluntary refund, credit, extension, or replacement does not waive RV MarketIQ's right to enforce these Terms later.
6.18 Chargebacks and Billing Disputes. If you believe a charge is incorrect, contact billing@RVMarketIQ.com within sixty (60) days after the charge. You agree not to initiate a chargeback for a valid charge without first making a good-faith effort to resolve the issue with RV MarketIQ, unless prohibited by law. A payment dispute, reversal, or chargeback may result in suspension of access, reversal of delivered Credits, restriction of future purchases, or termination where permitted by law.
6.19 Future Automatic Renewal Offers. If RV MarketIQ later offers an automatic-renewal consumer plan, continuous-service plan, or recurring-billing plan, RV MarketIQ will not enroll you unless the checkout or enrollment flow separately presents the automatic-renewal terms in a clear and conspicuous manner adjacent to the purchase action, obtains legally sufficient affirmative consent through a non-prechecked checkbox or equivalent affirmative mechanism, provides a post-enrollment acknowledgment identifying the renewal terms and cancellation method, provides any legally required advance renewal reminders, maintains records of consent, and provides an online cancellation method that is at least as easy to use as the enrollment method to the extent required by applicable law. Any such automatic-renewal offer will be governed by the terms presented at the time of enrollment.
6A. Pay-As-You-Go DealGuard Credits and Premium Daily Quota
6A.1 Scope. This Section governs DealGuard Credits, Credit Packs, Credit Batches, Credit Balances, Premium Daily Quota, and similar usage entitlements for DealGuard or related AI-assisted deal-intelligence features. This Section supplements, and does not replace, the payment, refund, tax, AI, privacy, data-retention, and termination provisions elsewhere in these Terms.
6A.2 Nature of DealGuard Credits. DealGuard Credits are closed-loop, non-monetary, prepaid digital service units redeemable solely within RVMarketIQ.com for Eligible DealGuard Analyses or other eligible DealGuard services that RV MarketIQ expressly designates. Credits are not money, currency, bank deposits, gift cards, gift certificates, stored value, payment instruments, negotiable instruments, securities, legal tender, escrow balances, or cash equivalents. Credits do not earn interest, are not insured by the FDIC or any government agency, and do not represent a deposit or financial account.
6A.3 Single-Merchant and Platform-Limited Use. DealGuard Credits may be redeemed only for RV MarketIQ's own services on the Platform. Credits cannot be used with any third-party merchant, seller, dealer, marketplace, escrow company, transport provider, inspection provider, lender, or payment service. Credits cannot be used to buy an RV, make a deposit, pay a Seller, send money, or pay for any off-platform transaction.
6A.4 Credit Pack Purchase and Delivery. Credit Packs are one-time purchases. Unless checkout states otherwise, purchased Credits are delivered to your account after RV MarketIQ or its payment processor confirms payment. RV MarketIQ may delay, deny, reverse, or manually review Credit delivery for fraud prevention, chargeback risk, account-security issues, payment failure, sanctions concerns, legal compliance, or other risk controls.
6A.5 Account Required. Credits are associated with the account used to purchase them. You must maintain an active, accessible account in good standing to use Credits. You are responsible for maintaining accurate account, billing, and contact information so RV MarketIQ can display balances, send receipts, send expiration notices, satisfy tax obligations, and comply with unclaimed-property laws.
6A.6 Premium Daily Quota. If offered, Premium users receive a Premium Daily Quota of up to twenty-five (25) Eligible DealGuard Analyses per UTC calendar day, unless checkout states a different quota. The Premium Daily Quota resets at 00:00 UTC each day, does not accumulate, does not roll over, is not transferable, is not redeemable for cash or Credits, and is lost if unused before reset. RV MarketIQ may modify quotas prospectively for future access terms, security, abuse prevention, cost control, or legal compliance.
6A.7 Basic, Free, and Non-Premium Users. Unless checkout states otherwise, Free and Basic users do not receive a Premium Daily Quota or included DealGuard access. RV MarketIQ may permit Free, Basic, or other non-Premium users to purchase Credit Packs and redeem Credits for Eligible DealGuard Analyses, subject to account status, geographic availability, risk controls, payment confirmation, checkout disclosures, and applicable law.
6A.8 Consumption Order. Unless checkout states otherwise, RV MarketIQ applies usage in this order: first, any available Premium Daily Quota; second, purchased DealGuard Credits using first-expiring-first-out order by Credit Batch; third, any promotional credits or other entitlements as displayed in the Platform; and fourth, a payment-required, upgrade, or purchase prompt if no quota or Credits remain. RV MarketIQ may correct erroneous consumption, duplicate deductions, failed-analysis deductions, or system miscalculations.
6A.9 Credit Balance and Dashboard. RV MarketIQ may display your Credit Balance, Credit Batches, expiration dates, usage history, and Premium Daily Quota in your account dashboard. Dashboard information is provided for convenience and may be corrected if inconsistent with RV MarketIQ's backend records, payment-processor records, fraud controls, tax records, or applicable law.
6A.10 Expiration of Purchased Credits. Unless checkout states a longer period or applicable law requires a longer period or no expiration, each purchased Credit Batch expires no earlier than five (5) years after the date of purchase. Credits are consumed first from the Credit Batch with the earliest expiration date. RV MarketIQ will use commercially reasonable efforts to display expiration dates in your account and may send pre-expiration notices by email or in-app notice. Failure to receive a notice does not extend the expiration date unless required by law.
6A.11 Promotional, Trial, or Courtesy Credits. Promotional, trial, beta, courtesy, replacement, or free Credits may be subject to different limits, expiration periods, eligibility rules, or revocation rights if disclosed at issuance. Promotional Credits distributed without payment may be revoked, modified, limited, or discontinued to the maximum extent permitted by law and do not create a purchased Credit Balance unless RV MarketIQ expressly states otherwise.
6A.12 No Refunds; No Cash Redemption. DealGuard Credits are non-refundable, non-exchangeable, and not redeemable for money, cash, or monetary value, except where RV MarketIQ expressly agrees or applicable law requires otherwise. If RV MarketIQ issues a discretionary refund for a Credit Pack, RV MarketIQ may reverse unused Credits and may reverse or offset any Credits already used, replacement credits, promotions, or related tax adjustments where permitted by law.
6A.13 Non-Transferability; No Gifts; No Resale. Credits are personal to the purchasing account and may not be sold, resold, assigned, transferred, gifted, donated, pledged, pooled, sublicensed, brokered, bartered, auctioned, inherited, or otherwise conveyed to another person or account, except where RV MarketIQ expressly authorizes a business-account workflow or applicable law requires otherwise. Any attempted transfer is void and may result in suspension or termination.
6A.14 Purchase Limits and Anti-Abuse Controls. RV MarketIQ may impose limits on Credit purchases, Credit Balances, daily purchase amounts, daily usage, payment methods, accounts, IP addresses, devices, geographic regions, or other factors to preserve the closed-loop nature of Credits, comply with prepaid-access thresholds, prevent fraud, manage cost, protect users, and comply with law. RV MarketIQ may decline or manually review unusually large, suspicious, repeated, automated, or abusive purchases.
6A.15 Taxes and Sourcing. Prices shown for Credit Packs are exclusive of applicable taxes unless checkout states otherwise. Taxes, if any, are calculated based on your billing address, account address, purchase location, or other legally relevant information available at checkout. Credit purchases are sourced to the billing information associated with the purchase unless applicable law requires a different sourcing rule. RV MarketIQ does not provide tax advice and may change tax treatment prospectively as laws, guidance, product classification, or payment-processor settings change.
6A.16 Unclaimed Property and Abandoned Credits. Unused Credits may be subject to state unclaimed-property, abandoned-property, escheat, or similar laws. RV MarketIQ may collect and retain address, purchase, usage, expiration, and communication records to determine reporting obligations. If required by law, RV MarketIQ may report or remit the value of unused Credits to the applicable state authority after the applicable dormancy period and legally required notice process. If Credits are remitted to a state, you may need to contact that state authority to claim any value available to you under that state's process.
6A.17 No Dormancy Fees. RV MarketIQ does not currently charge dormancy, inactivity, maintenance, service, or balance-reduction fees on purchased DealGuard Credits. If RV MarketIQ ever introduces any such fee, RV MarketIQ will do so only prospectively, with legally required disclosures, and only to the extent permitted by applicable law.
6A.18 Account Closure, Suspension, and Termination. If you voluntarily close your account, request deletion of your account, materially breach these Terms, commit fraud, misuse Credits, initiate an improper chargeback, violate payment rules, or create legal, security, privacy, safety, operational, or reputational risk, RV MarketIQ may suspend access to Credits, reverse Credits, terminate access, or forfeit unused Credits to the maximum extent permitted by law. If RV MarketIQ terminates your account without cause while you hold purchased Credits, RV MarketIQ will use commercially reasonable efforts to provide a legally compliant remedy, such as continued access through expiration, transfer to a replacement account, replacement Credits, refund, or other treatment required or permitted by law.
6A.19 Chargebacks, Unauthorized Payments, and Reversals. If a Credit Pack purchase is reversed, refunded, disputed, charged back, deemed unauthorized, or not completed, RV MarketIQ may reverse the corresponding Credits, block further use, offset future Credits, suspend the account, or require repayment to the extent permitted by law. Nothing in these Terms limits rights you may have for unauthorized transactions or billing errors under applicable payment-card, consumer-protection, or other laws.
6A.20 Discontinuation or Modification of Credit Sales. RV MarketIQ may stop selling Credit Packs, modify pack sizes, modify prices, change eligible usage units, discontinue DealGuard, or replace DealGuard with a successor feature prospectively. If RV MarketIQ discontinues Credit sales, RV MarketIQ will use commercially reasonable efforts to honor previously purchased unused Credits through their expiration date or provide another legally compliant remedy.
6A.21 Required Checkout Disclosures and Acknowledgments. Credit Pack checkout may require you to acknowledge material terms, including expiration, no refunds, non-transferability, no cash redemption, account-access requirements, chargeback consequences, order of consumption, tax treatment, and unclaimed-property disclosures. RV MarketIQ may block purchase unless required acknowledgments are completed.
6A.22 Legal Savings Clause. If applicable law requires longer expiration, no expiration, cash redemption below a threshold, different disclosures, unclaimed-property reporting, tax collection, refund treatment, transfer rights, or other treatment for Credits in a particular jurisdiction, the legally required treatment applies for users or transactions subject to that law, and the affected provision of this Section is limited to the maximum extent permitted by law.
7. Platform as Marketplace and Discovery Layer
7.1 Discovery Layer Only. RV MarketIQ may display, organize, import, aggregate, analyze, rank, summarize, or link to RV Listings and related data. RV MarketIQ is not the owner, seller, dealer, broker, auctioneer, consignor, lender, insurer, inspector, warranty provider, transport provider, or escrow agent for third-party Listings.
7.2 No Transaction Guarantee. RV MarketIQ does not guarantee that any Listing is available, accurately priced, lawfully offered, free of liens, in good condition, titled correctly, safe, towable, insurable, financeable, or owned by the person offering it.
7.3 Off-Platform Transactions. Transactions with Sellers, Dealers, buyers, auction platforms, finance providers, transport providers, inspection providers, warranty providers, and other third parties are solely between you and those third parties. You assume all transaction risks.
7.4 User Responsibility. You are responsible for verifying identity, title, ownership, condition, mileage, VIN, liens, taxes, fees, escrow instructions, payment instructions, delivery, inspection, insurance, registration, towing capability, and legal requirements before acting.
8. Listing Data; Third-Party Sources; Accuracy Disclaimers
8.1 Sources. Listings and related information may come from public websites, dealer websites, auction sites, marketplace feeds, user submissions, APIs, imported URLs, third-party data providers, government sources, and internal datasets.
8.2 Data May Be Wrong or Stale. Listing data may be inaccurate, incomplete, stale, duplicated, misclassified, misparsed, unavailable, or inconsistent with the original source. Prices, photos, descriptions, locations, features, availability, mileage, model years, and seller details may change without notice.
8.3 Images and Photos. Listing photos, thumbnails, screenshots, and images may be third-party content. RV MarketIQ does not claim ownership of third-party images and may remove or restrict images in response to legal, copyright, privacy, source-platform, or operational concerns.
8.4 Source Terms. Third-party sources may impose terms, robots restrictions, access limitations, rate limits, or other restrictions. RV MarketIQ may modify or stop using a source at any time.
8.5 No Verification. Unless expressly stated, RV MarketIQ does not physically inspect RVs, verify seller authority, verify title, verify ownership, verify loan payoff amounts, verify listing accuracy, or verify vehicle condition.
8.6 User-Submitted Corrections. Users may submit corrections or feedback. RV MarketIQ may accept, reject, investigate, or ignore corrections in its discretion.
8.7 Archived Listings. RV MarketIQ may archive expired or stale Listings and may retain archived Listing data for analytics, fraud prevention, valuation, historical comparison, internal operations, or legal compliance. Unless otherwise stated in the Privacy Policy, the default retention period for user-specific archived Listing data is twelve (12) months following expiration of your access term, after which data may be deleted, anonymized, or retained in aggregated or source-level form.
9. Private Seller Listings and Dealer Listings
9.1 Seller-Generated Content. Sellers and Dealers are responsible for their Listings, descriptions, prices, photos, representations, disclosures, title status, inventory status, financing representations, warranty representations, and transaction terms.
9.2 Dealer Obligations. Dealers must comply with all applicable dealer, advertising, consumer-protection, licensing, titling, financing, warranty, privacy, data-security, tax, and recordkeeping laws. Dealers must not advertise financing terms, monthly payments, down payments, APR, credit availability, warranties, or other regulated terms unless they have legal authority and provide all legally required disclosures.
9.3 Private Sellers. Private Sellers must have authority to sell the RV or vehicle they list and must not misrepresent ownership, title, liens, damage, flood history, salvage history, odometer readings, or condition.
9.4 No Seller or Dealer Agency. No Seller, Dealer, or listing source is RV MarketIQ’s agent, employee, partner, representative, or authorized spokesperson unless a separate written agreement signed by RV MarketIQ expressly states otherwise.
9.5 Removal Rights. RV MarketIQ may remove, restrict, label, or deprioritize Listings, Seller accounts, Dealer accounts, or related content for suspected fraud, inaccuracy, infringement, privacy risk, safety risk, policy violation, legal risk, or any other reason.
10. Buyer Inquiry System; Sharing of Buyer Contact Information
10.1 Message Relay. The Platform may allow prospective buyers to contact Sellers or Dealers through Buyer Inquiry forms. RV MarketIQ acts as a message relay and recordkeeping system only. RV MarketIQ is not responsible for the Seller’s or Dealer’s response, conduct, representations, privacy practices, or transaction terms.
10.2 PII Sharing Disclosure. When you submit a Buyer Inquiry, you authorize RV MarketIQ to collect, store, process, and share the information you submit, including your name, email address, phone number, timeline, message, and related details, with the Seller, Dealer, or listing contact associated with the Listing.
10.3 Affirmative Consent. Before submitting a Buyer Inquiry, you must affirmatively authorize the collection, storage, processing, and sharing described in this Section 10 through a checkbox, button, form submission after the disclosure is displayed, or equivalent consent mechanism. RV MarketIQ may block submission of a Buyer Inquiry unless the required consent is provided and may record the consent timestamp, Listing ID, account identifier, submitted contact fields, and related metadata.
10.4 Seller Use of Buyer Information. Sellers and Dealers receiving Buyer Inquiry information may use it only to respond to the specific inquiry, coordinate the potential transaction, and comply with legal obligations. Sellers and Dealers may not use Buyer Inquiry information for unrelated marketing, resale, profiling, publication, harassment, spam, or transfer to unrelated third parties.
10.5 Buyer Identity Not Verified. RV MarketIQ does not verify buyer identity, employment, funds, creditworthiness, intent, driving history, insurance, licensing, or authority to purchase.
10.6 Seller Identity Not Fully Verified. RV MarketIQ may perform certain verification steps for Dealers or Sellers, but RV MarketIQ does not guarantee identity, honesty, authority, inventory ownership, title, solvency, or compliance.
10.7 Lead Retention. Buyer Inquiry records may be retained for customer service, fraud prevention, dispute resolution, Seller dashboard access, analytics, legal compliance, and Platform operations. Unless the Privacy Policy states otherwise, the default retention period is twelve (12) months after the first to occur of Seller account expiration or Seller account deletion, subject to privacy requests, legal holds, backup limitations, and operational limitations.
10.8 Deletion Requests. If you want to request deletion of Buyer Inquiry information, contact support@RVMarketIQ.com. RV MarketIQ will process deletion requests according to the Privacy Policy and applicable law. Because Buyer Inquiry information may have been shared with a Seller or Dealer, RV MarketIQ may not be able to delete copies already received, stored, exported, or used by that Seller or Dealer, but RV MarketIQ may require Sellers and Dealers to comply with applicable deletion obligations.
10.9 Anti-Spam and Rate Limits. RV MarketIQ may limit, throttle, block, delay, review, or require authentication for Buyer Inquiries to prevent spam, abuse, harassment, fraud, scraping, denial-of-service activity, or privacy misuse.
10.10 No Confidential Information in Inquiries. Do not include Social Security numbers, financial account numbers, payment card numbers, driver’s license images, medical information, privileged information, passwords, login credentials, or other sensitive information in a Buyer Inquiry.
11. VIN Lookup and Vehicle History Data
11.1 VIN Data Sources. RV MarketIQ may provide VIN decoding, manufacturer, model year, recall, and vehicle-specification information from government databases, public sources, third-party providers, APIs, and manufacturer-submitted information, including the NHTSA vPIC system.
11.2 No Accuracy Guarantee. VIN decoding and vehicle-history data may be incomplete, outdated, inaccurate, misclassified, or unavailable. You must verify VIN, title, model, trim, manufacturer information, recall status, and vehicle history through authoritative sources before relying on them.
11.3 No Title or Lien Search. RV MarketIQ does not perform title searches, lien searches, odometer verification, salvage verification, branded-title verification, flood verification, or ownership verification unless a separate written agreement signed by RV MarketIQ expressly states otherwise.
11.4 Recalls and Safety. Recall information may be incomplete or delayed. You should verify recalls with the manufacturer, NHTSA, dealer, or other authoritative source.
12. MarketIQ Value and Valuation Engine
12.1 Algorithmic Estimate Only. MarketIQ Value, estimated market price, price range, confidence label, comparable count, market explanation, and related pricing outputs are algorithmic estimates only.
12.2 Not an Appraisal. MarketIQ Value is not a professional appraisal, licensed appraisal, USPAP appraisal, dealer appraisal, insurance appraisal, tax appraisal, trade-in offer, purchase offer, sale offer, guarantee of resale value, guarantee of transaction price, or representation of actual market value.
12.3 No Appraiser Relationship. RV MarketIQ is not an appraiser and does not provide appraisal services through MarketIQ Value unless a separate written agreement signed by RV MarketIQ expressly states otherwise.
12.4 Data Sources. MarketIQ Value may be derived from comparable listings, sold listings, auction data, dealer data, user-submitted data, imported URLs, third-party pricing feeds, historical data, statistical models, and other sources. Data sources may be incomplete, biased, stale, unavailable, or not comparable to the specific RV or vehicle you are evaluating.
12.5 Confidence Labels. A confidence label describes the quality, quantity, recency, or consistency of available comparable data. It does not guarantee accuracy.
12.6 Wholesale vs. Retail. If RV MarketIQ displays wholesale, auction-derived, book-value, dealer, private-party, or retail estimates, those labels are informational. Wholesale or auction-derived prices may not represent retail market value. Book values may be licensed third-party estimates and not RV MarketIQ appraisals.
12.7 Future Third-Party Pricing Sources. RV MarketIQ may integrate third-party pricing sources, including live comparable listings, book-value providers, wholesale auction sources, or other data providers. When such values are displayed, RV MarketIQ may identify the source or category where reasonably practicable and subject to provider contracts.
12.8 Blended Estimates. If multiple data sources are blended into a single estimate, the blended estimate is not a single authoritative number and should not be treated as such.
12.9 No Reliance as Sole Basis. You must not rely on MarketIQ Value as the sole basis for buying, selling, bidding, financing, insuring, taxing, towing, or transporting an RV or vehicle.
12.10 Objective-Loss and Value Acknowledgment. You acknowledge that market estimates are not promises that you will obtain a particular price or that any RV is worth a particular amount. Your actual transaction outcome may differ materially because of condition, title, location, negotiation, timing, demand, financing, dealer practices, private-seller conduct, options, damage, liens, taxes, fees, transport, and other factors.
12.11 No Liability for Valuation Decisions. To the maximum extent permitted by law, RV MarketIQ is not liable for losses arising from reliance on any valuation, estimate, confidence label, comparable, or price explanation.
13. Tow Capacity Estimator; Safety Disclaimer; Assumption of Risk
13.1 Informational Tool Only. The Tow Capacity Estimator is an informational tool only. It is not safety advice, engineering advice, mechanical advice, legal advice, insurance advice, manufacturer guidance, a towing certification, a roadworthiness determination, or a substitute for professional inspection.
13.2 Independent Verification Required. Before towing, you must independently verify all towing-related information using authoritative sources, including your vehicle owner’s manual, manufacturer towing guide, driver-side door placard, payload sticker, GVWR, GCWR, GAWR, curb weight, payload capacity, tongue weight, hitch receiver rating, weight-distribution hitch rating, tire load rating, axle rating, brake-controller requirements, state-law requirements, and manufacturer or dealer guidance.
13.3 Estimator Limitations. The Tow Capacity Estimator may not know or account for your actual vehicle condition, trim, engine, axle ratio, drivetrain, wheelbase, modifications, aftermarket parts, tires, brakes, hitch installation, hitch class, hitch condition, weight-distribution setup, sway control, payload sticker, passengers, cargo, water, propane, batteries, generators, tools, accessories, elevation, grade, wind, road conditions, weather, driver experience, maintenance, or legal requirements.
13.4 RV Weight Variability. RV weights vary by model, options, cargo, tanks, aftermarket equipment, batteries, solar systems, accessories, and user loading. Published dry weight, unloaded vehicle weight, gross vehicle weight rating, cargo carrying capacity, hitch weight, pin weight, and tongue weight may be inaccurate, outdated, or unsuitable for your actual configuration.
13.5 No Safe-to-Tow Representation. RV MarketIQ does not represent, warrant, or guarantee that any vehicle can safely tow any RV, trailer, camper, fifth-wheel, toy hauler, or other load identified by the Tow Capacity Estimator.
13.6 You Assume Towing Risk. You are solely responsible for towing decisions and for obtaining professional advice when needed. You assume all risks associated with towing, including property damage, mechanical damage, tire failure, brake failure, drivetrain damage, hitch failure, sway, loss of control, citations, insurance denial, bodily injury, and death.
13.7 EXPRESS RELEASE FOR NEGLIGENCE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND DISCHARGE RV MARKETIQ AND ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, LICENSORS, AND SUPPLIERS FROM CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF OR RELIANCE ON THE TOW CAPACITY ESTIMATOR, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE, FAULT, OR CARELESSNESS OF RV MARKETIQ OR ANY RELEASED PARTY, EXCEPT TO THE EXTENT SUCH RELEASE IS PROHIBITED BY LAW.
13.8 No Emergency or Safety-Critical Use. Do not use the Tow Capacity Estimator for emergency decisions, commercial transport compliance, professional towing operations, or any safety-critical decision without independent professional verification.
13.9 Saved Tow Data May Expire. Tow Capacity Estimator inputs, calculations, saved tow profiles, vehicle/RV pairings, and related notes may become inaccessible, archived, deleted, or anonymized after your access term expires as described in Section 6.8.
13.10 Limitation of Liability. To the maximum extent permitted by law, RV MarketIQ is not liable for any loss, damage, injury, death, citation, insurance issue, warranty issue, mechanical failure, or transaction decision arising from use of or reliance on the Tow Capacity Estimator. Nothing in these Terms limits liability that cannot legally be limited.
14. DealGuard Scam Detection and Risk Analysis
14.1 Informational Only. DealGuard provides informational fraud-pattern analysis based on user-submitted content, public scam-pattern information, third-party sources, internal signals, user feedback, and AI-assisted analysis. DealGuard is not legal, financial, investigative, law-enforcement, insurance, escrow, banking, or fraud-guarantee advice.
14.2 Probabilistic Labels. DealGuard risk labels, including LOW, WATCH, HIGH, VERY HIGH, or similar labels, are probabilistic assessments. A HIGH or VERY HIGH label is not proof that a Seller, Dealer, Listing, person, message, or transaction is fraudulent. A LOW label is not a safety certificate and does not mean the transaction is legitimate.
14.3 No Detection Guarantee. DealGuard cannot detect all scams, fraud patterns, misrepresentations, identity theft, title issues, payment fraud, shipping fraud, escrow fraud, phishing, spoofing, impersonation, or other misconduct. Scammers may use new or uncommon tactics that DealGuard does not detect.
14.4 False Positives and False Negatives. DealGuard may generate false positives by flagging legitimate Sellers, messages, or Listings as risky. DealGuard may generate false negatives by failing to flag fraudulent Sellers, messages, or Listings.
14.5 No Sole Reliance. You must not rely solely on DealGuard. You should independently verify identity, title, ownership, payment instructions, escrow providers, VIN, listing source, Seller authority, vehicle condition, transaction documents, and red flags before sending money or committing to a transaction.
14.6 Third-Party Subjects. DealGuard may analyze communications, Listings, or information involving third parties. DealGuard outputs are not statements of fact about any specific third party and must not be presented, published, or shared as definitive accusations of fraud, dishonesty, criminal conduct, or misconduct.
14.7 User Sharing Restrictions. You may use DealGuard outputs for your own transaction evaluation. You may not publicly post, republish, sell, weaponize, or distribute DealGuard outputs in a manner that is defamatory, misleading, harassing, threatening, deceptive, or likely to interfere unlawfully with another person’s business or reputation.
14.8 No Investigation. RV MarketIQ does not conduct a law-enforcement investigation, private investigation, background check, identity verification, title search, lien search, or financial verification when generating a DealGuard output.
14.9 Scam Pattern Library. DealGuard may use a scam-pattern library derived from publicly available government sources, consumer alerts, complaints, public reports, community reports, online forums, internal user feedback, and other sources. RV MarketIQ does not independently verify every source, report, or pattern and does not guarantee that the library is current, complete, or accurate.
14.10 DealGuard Data-Loss Warning. DealGuard threads, uploaded communications, screenshots, notes, risk labels, and negotiation history may become inaccessible, archived, deleted, or anonymized after your access term expires. Pay-As-You-Go access, Premium Daily Quota, and DealGuard Credits are governed by Section 6A. You should export or copy important materials before expiration.
14.11 No Liability for Scam Outcomes. To the maximum extent permitted by law, RV MarketIQ is not liable for losses arising from missed scams, false positives, false negatives, user reliance, seller reliance, user sharing of outputs, abandoned transactions, defamation-adjacent claims, tortious-interference-adjacent claims, or transaction outcomes.
15. Risk Overrides
15.1 Proceeding Despite Warning. If DealGuard assigns an elevated risk label and you choose to proceed, you do so at your own risk.
15.2 Logging. RV MarketIQ may log risk override decisions, including user ID, thread ID, risk label, timestamp, and related metadata, for internal analytics, fraud prevention, service improvement, dispute resolution, and legal compliance.
15.3 Not Public. Risk override logs are not public records. RV MarketIQ does not share risk override logs with Sellers, Dealers, or counterparties except as described in the Privacy Policy, with your consent, as needed to operate the Platform, or in response to valid legal process.
15.4 Retention. Unless the Privacy Policy states otherwise, the default retention period for risk override logs is twelve (12) months following expiration of your access term, after which data may be deleted, anonymized, or retained in aggregated form, subject to deletion requests, legal holds, and operational needs.
16. Negotiation Agent; GPT-Generated Guidance
16.1 Generative AI Tool. The Negotiation Agent is a generative AI-assisted tool, including GPT-powered features, that may generate negotiation strategy, suggested offer ranges, tactic suggestions, talking points, draft messages, counteroffers, summaries, and other AI Outputs.
16.2 Not Legal, Financial, Tax, Insurance, Appraisal, or Professional Advice. Negotiation Agent outputs are general informational suggestions only. They are not legal advice, financial advice, tax advice, insurance advice, appraisal advice, investment advice, professional negotiation representation, or a substitute for advice from a qualified professional.
16.3 No Attorney-Client Relationship. Use of the Negotiation Agent does not create an attorney-client relationship, prospective-client relationship, engagement, retainer, fiduciary relationship, or confidential attorney communication with RV MarketIQ, any Platform operator, or any licensed attorney associated with RV MarketIQ.
16.4 Operator’s Attorney Status Does Not Change This. The fact that any owner, employee, advisor, contractor, or operator of RV MarketIQ may be a licensed attorney does not transform the Platform, DealGuard, the Negotiation Agent, or any AI Output into legal advice or legal services.
16.5 Outputs May Be Wrong. Negotiation Agent outputs may be inaccurate, incomplete, outdated, commercially unreasonable, legally risky, inappropriate, too aggressive, too weak, offensive, confusing, or unsuitable for your circumstances.
16.6 User Review Required. You are solely responsible for reviewing, editing, approving, and deciding whether to send any generated message. Do not send any message unless you have read it and determined that it is accurate, lawful, appropriate, and consistent with your intentions.
16.7 No Sending Unless Expressly Provided. Unless RV MarketIQ separately offers and you separately authorize a feature that sends communications on your behalf, the Negotiation Agent does not send messages for you. You are responsible for any message you send, copy, modify, forward, post, or rely on.
16.8 No Outcome Guarantee. RV MarketIQ does not guarantee that the Negotiation Agent will produce a lower price, better terms, a successful purchase, a Seller response, fraud avoidance, a refund, delivery, title transfer, financing approval, or any other outcome.
16.9 No Misuse. You may not use the Negotiation Agent to harass, threaten, defame, deceive, impersonate, discriminate, violate platform rules, commit fraud, pressure vulnerable persons, make false statements, evade laws, or engage in unfair or deceptive conduct.
16.10 Saved Negotiation Data May Expire. Negotiation Agent threads, generated messages, offer history, notes, and deal progress records may become inaccessible, archived, deleted, or anonymized after your access term expires as described in Section 6.8. Pay-As-You-Go Credit usage for DealGuard-related negotiation features, if any, is governed by Section 6A. You should export or copy important negotiation materials before expiration.
16.11 User-Sent Message Risk. If you use or adapt a generated message, you are responsible for the final content. Generated negotiation messages may create contractual, reputational, fraud, defamation, consumer-protection, or platform-rule consequences depending on what you send and how the recipient responds.
16.12 No Liability for Negotiation Outcomes. To the maximum extent permitted by law, RV MarketIQ is not liable for losses, failed negotiations, overpayment, underpayment, lost deals, Seller disputes, defamation claims, contract disputes, or other harm arising from use of or reliance on the Negotiation Agent.
17. Import / Analyze My Listing; URL Submission
17.1 User-Submitted URLs. The Platform may allow you to submit a URL from a third-party listing, marketplace, classified site, dealer site, auction site, or other website for import, extraction, analysis, valuation, scam screening, or saving.
17.2 Server-Side Fetching. By submitting a URL, you authorize RV MarketIQ to fetch, access, process, parse, store, analyze, and display extracted information from that URL for purposes of providing the requested service.
17.3 Legitimate Interest Required. You represent and warrant that you have a legitimate, lawful interest in submitting the URL and that submitting the URL does not violate applicable law, contract, privacy rights, intellectual-property rights, confidentiality obligations, or source-platform restrictions.
17.4 Do Not Submit Private or Sensitive URLs. You may not submit URLs that are private, non-public, behind authentication, paywalled without authorization, internal, confidential, personal, financial, medical, privileged, security-sensitive, illegal, or unrelated to legitimate RV or vehicle shopping, selling, valuation, or analysis.
17.5 No Circumvention. You may not use the import feature to bypass authentication, robots restrictions, rate limits, CAPTCHAs, IP blocks, technical restrictions, contractual restrictions, or access controls.
17.6 Extraction Accuracy. Extracted titles, prices, years, makes, models, descriptions, photos, images, specifications, seller details, and other fields may be incomplete, inaccurate, stale, misparsed, or unavailable. You must verify extracted information at the original source.
17.7 Limited Private Use. Unless RV MarketIQ states otherwise, imported URL data is stored in your account for your private use and analysis and is not intended to republish third-party narrative descriptions publicly.
17.8 Rate Limits. RV MarketIQ may impose import limits, including limits per account, IP address, source, URL, or time period. A contemplated default is twenty (20) import requests per hour per account, but RV MarketIQ may change this limit at any time.
17.9 Certain Platforms May Not Be Supported. Some third-party platforms may block or limit server-side fetching, especially authenticated or private marketplaces. RV MarketIQ may require manual completion of fields or may provide low-confidence results where extraction is limited.
17.10 Source-Platform Restrictions; C&D Communications. RV MarketIQ intends to use commercially reasonable technical or manual controls to respect source-platform restrictions that RV MarketIQ can reasonably identify, including technical access restrictions, robots.txt directives, rate limits, cease-and-desist communications, contractual restrictions, IP blocks, access-control signals, source-platform requests, or other source-platform restrictions. RV MarketIQ may suspend, block, throttle, remove, or discontinue import support for any source platform, domain, URL pattern, or data source at any time, including after receiving a source-platform objection or determining that continued access creates legal, operational, or business risk. Nothing in these Terms obligates RV MarketIQ to continue importing, analyzing, or displaying any third-party source.
17.11 Indemnity for Submitted URLs. You must indemnify RV MarketIQ for claims, demands, losses, damages, costs, and expenses arising from URLs you submit, including claims that fetching, processing, storing, or analyzing the URL violated a third party’s rights, terms, or laws.
18. AI Processing; Third-Party AI Providers
18.1 AI Providers. RV MarketIQ may use third-party AI providers, including OpenAI and other providers, to process text, images, screenshots, audio, PDFs, transcriptions, URLs, Listings, scam-analysis content, negotiation content, valuation content, towing-related content, and other Submitted Content.
18.2 Transmission to Providers. By using AI-assisted features, you authorize RV MarketIQ to transmit relevant Submitted Content, metadata, and context to AI providers for processing, analysis, transcription, classification, extraction, embedding, retrieval, generation, safety review, and related purposes.
18.3 Text, Image, PDF, and Audio Processing. AI-assisted features may process pasted messages, seller communications, Listing text, screenshots, images, PDFs, audio recordings, transcripts, Listing URLs, extracted Listing data, and user feedback.
18.4 Audio Transcription. If you upload audio, RV MarketIQ may transmit the audio to an AI transcription provider, including OpenAI transcription models, for transcription and analysis. Transcriptions may be inaccurate and must be reviewed before reliance.
18.5 Provider Data Handling. AI providers process data according to their own terms, privacy policies, data-processing terms, and retention controls. RV MarketIQ does not control all provider data practices. To the extent supported by provider settings and agreements, RV MarketIQ does not authorize third-party AI providers to train their general foundation models on customer API inputs or outputs unless RV MarketIQ expressly discloses otherwise or you opt in. However, providers may retain data for abuse monitoring, security, compliance, application state, or other purposes according to their applicable policies and controls.
18.6 No Zero-Retention Promise. RV MarketIQ does not promise zero data retention by any AI provider unless RV MarketIQ expressly states that such controls are active for the applicable feature and provider. Different AI endpoints may have different retention, abuse-monitoring, and application-state rules.
18.7 AI Output Limitations. AI Outputs may be inaccurate, incomplete, biased, unsafe, outdated, hallucinated, or unsuitable. You are responsible for independently verifying AI Outputs.
18.8 No High-Stakes Use Without Verification. You may not rely on AI Outputs as the sole basis for high-stakes decisions, including sending money, buying or selling an RV, towing, driving, financing, insuring, signing legal documents, accusing someone of fraud, terminating a transaction, or making legal claims.
18.9 Human Review. You are responsible for human review of any AI Output before use, publication, sharing, sending, or reliance.
19. AI Improvement; Feedback; De-Identified Data; Optional Training Consent
19.1 Operational Improvement. RV MarketIQ may use usage data, Submitted Content, feedback, risk labels, outcome feedback, confirmed scam feedback, confirmed legitimate-deal feedback, override logs, error reports, and other interaction data to operate, debug, secure, evaluate, maintain, and improve the Platform.
19.2 Feedback Flywheel; Operational Fraud-Pattern Retrieval. If you provide feedback such as “Was a scam,” “Legit deal,” or similar outcome feedback, you authorize RV MarketIQ to process the relevant feedback, DealGuard thread, related messages, AI Outputs, and associated metadata to improve DealGuard and related fraud-detection, retrieval, safety, and abuse-prevention features. This operational processing may include using AI providers to extract scam types, phrases, tags, signals, summaries, and similar derived information; creating and storing embeddings; storing derived signals in an internal vector database or retrieval system; and using those derived signals for internal retrieval, analytics, fraud prevention, quality review, and service improvement. This operational fraud-pattern retrieval is not intended to train or fine-tune a generative AI model unless RV MarketIQ uses the content to update model weights, fine-tune a model, or train a model in a manner requiring Optional Training Consent under Section 19.5.
19.3 De-Identified Improvement Data. RV MarketIQ may use De-identified Data derived from user interactions, conversation submissions, outcome feedback, negotiation interactions, imported Listings, towing interactions, valuation interactions, and related usage data to improve fraud detection, negotiation guidance, valuation tools, towing tools, search, ranking, and other features.
19.4 No Ownership Transfer. RV MarketIQ does not claim ownership of your Submitted Content solely because it uses De-identified Data or limited operational licenses described in these Terms.
19.5 Optional Training Consent for Identifiable DealGuard Data. RV MarketIQ will not intentionally use identifiable DealGuard submissions, uploaded seller communications, negotiation threads, screenshots, PDFs, audio recordings, or related user-specific deal files to train or fine-tune generative AI models unless you affirmatively opt in through Optional Training Consent or another legally sufficient consent mechanism. For clarity, the operational fraud-pattern retrieval and internal RAG-style processing described in Section 19.2 is treated as operational fraud prevention, safety, retrieval, and service-improvement processing, not generative AI model training or fine-tuning, unless RV MarketIQ uses the underlying content to update model weights, fine-tune a model, or train a generative model.
19.6 What Optional Training Consent May Cover. If you opt in, RV MarketIQ may use the covered Submitted Content, related AI Outputs, feedback, labels, outcomes, and derived data to train, fine-tune, evaluate, benchmark, test, improve, or validate RV MarketIQ’s scam-detection, negotiation-assistance, valuation, towing, classification, retrieval, and related systems. RV MarketIQ will use reasonable efforts to remove or mask direct identifiers before such use, but de-identification is not a guarantee that re-identification is impossible.
19.7 Third-Party Information in Training Data. If you opt in to training use for materials that include third-party seller messages, phone numbers, emails, names, images, listing information, or other personal information, you represent that you are legally permitted to submit those materials and authorize the described processing.
19.8 Withdrawal of Optional Training Consent. You may withdraw Optional Training Consent prospectively by using an in-app control, if available, or by emailing privacy@RVMarketIQ.com with the subject line “AI Training Consent Withdrawal.” Withdrawal does not prevent RV MarketIQ from using data to provide requested services, maintain security, comply with law, prevent fraud, perform internal analytics, use aggregated or de-identified data, perform the operational fraud-pattern retrieval described in Section 19.2, or retain data as required or permitted by law. Withdrawal may not require RV MarketIQ to unwind prior model training, fine-tuning, benchmarking, evaluation, retrieval-indexing, derived-signal creation, or model-weight changes where doing so is not technically feasible or legally required.
19.9 California and Sensitive Data. RV MarketIQ will not intentionally use identifiable DealGuard submissions from California residents for generative AI training or fine-tuning without Optional Training Consent. RV MarketIQ may decline to use certain categories of sensitive personal information for training even if a user opts in.
19.10 Third-Party Foundation Model Training. RV MarketIQ does not authorize third-party AI providers to train their general foundation models on RV MarketIQ customer API inputs or outputs unless RV MarketIQ expressly discloses that use and obtains any consent required by law.
20. User-Submitted Content License
20.1 You Retain Ownership. As between you and RV MarketIQ, you retain ownership of your Submitted Content, subject to the licenses and rights granted in these Terms.
20.2 License to Operate the Platform. You grant RV MarketIQ a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, process, transmit, display, perform, modify, adapt, analyze, summarize, translate, transcribe, extract, index, embed, generate outputs from, and otherwise use Submitted Content as reasonably necessary or useful to operate, provide, secure, maintain, debug, evaluate, improve, and support the Platform and related services.
20.3 Listing Content License. If you submit a Listing, photos, descriptions, prices, or Seller information, you grant RV MarketIQ a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to display, reproduce, store, distribute, promote, index, transmit, and otherwise use that content in connection with the Platform, search, alerts, dealer dashboards, buyer inquiries, partner integrations, and related marketing or marketplace functions.
20.4 Training-License Limit. The operational license in Section 20.2 does not, by itself, authorize RV MarketIQ to use identifiable DealGuard submissions for generative AI training or fine-tuning where Section 19 requires Optional Training Consent.
20.5 Third-Party Communications. If you paste or upload seller communications, screenshots, emails, texts, chat messages, voice recordings, PDFs, or other communications, you represent and warrant that you are a party to, authorized recipient of, or otherwise legally permitted to submit those communications.
20.6 Third-Party Personal Information. Submitted Content may contain third-party personal information, including Seller phone numbers, emails, addresses, names, images, license plates, financial details, or communications. You are responsible for ensuring you have the legal right to submit that information.
20.7 No Unauthorized Interception. You may not submit content obtained through hacking, unauthorized access, unauthorized interception, illegal recording, wiretapping, credential misuse, deception, or violation of law.
20.8 No Confidential or Privileged Information. Do not submit confidential, privileged, trade secret, medical, legal, financial account, password, Social Security, or similarly sensitive information unless the feature expressly requires it and you understand the risks. RV MarketIQ is not a secure legal, medical, financial, or professional-services portal.
20.9 Representations. You represent and warrant that Submitted Content does not violate law, infringe intellectual-property rights, violate privacy or publicity rights, defame any person, breach confidentiality obligations, or violate these Terms.
20.10 Removal. RV MarketIQ may remove, restrict, or disable access to Submitted Content for any reason, including suspected illegality, infringement, fraud, privacy risk, safety risk, or violation of these Terms.
21. Image, Screenshot, PDF, and Audio Uploads
21.1 Uploads. The Platform may allow you to upload images, screenshots, PDFs, audio recordings, Listing photos, vehicle photos, documents, or other files.
21.2 Sensitive Information Warning. Do not upload images, PDFs, or audio containing faces, license plates, addresses, driver’s licenses, Social Security numbers, bank information, payment cards, medical information, legal files, confidential records, passwords, or other sensitive information unless necessary for the feature and lawful to submit.
21.3 Consent for Depicted Persons. You represent and warrant that you have all rights and consents needed to upload images or audio containing third-party faces, voices, names, contact information, license plates, property, or identifying details.
21.4 Audio Recording Consent. Laws governing audio recording vary by jurisdiction. Some states require consent of all recorded parties. You represent and warrant that you have obtained all legally required consents before uploading any audio recording.
21.5 No Biometric Identification. RV MarketIQ does not intend to perform face recognition, facial-geometry identification, biometric identification, or voiceprint identification unless RV MarketIQ expressly discloses and obtains any required consent. You may not upload content for biometric identification purposes.
21.6 Transcription Accuracy. Transcriptions may be inaccurate, incomplete, or omit context. You must review transcripts before relying on them.
21.7 Upload Limits. RV MarketIQ may impose limits on file size, file type, number of uploads, storage duration, or processing frequency. RV MarketIQ may reject, delete, compress, resize, or restrict uploaded files.
21.8 No Liability for Upload Violations. You are solely responsible for uploaded content and must indemnify RV MarketIQ for claims arising from uploaded content, including privacy, recording-consent, copyright, publicity, defamation, and confidentiality claims.
22. Data Collection, Privacy, Retention, and Deletion
22.1 Privacy Policy. RV MarketIQ's collection, use, sharing, and retention of personal information is described in the Privacy Policy. These Terms supplement the Privacy Policy but do not replace it. RV MarketIQ's Privacy Policy is or will be published separately and incorporated by reference.
22.2 Categories of Data. RV MarketIQ may collect and process account information, email address, name, profile image, authentication identifiers, payment metadata, access-plan status, Credit Pack purchase records, Credit Balances, Credit Batch records, credit expiration dates, quota usage, Buyer Inquiry information, Seller information, Dealer information, Submitted Content, DealGuard threads, messages, conversation turns, embeddings, summaries, negotiation notes, offer amounts, imported Listing drafts, Listing snapshots, tow profiles, valuation interactions, watchlists, alerts, risk override logs, feedback, device information, IP address, usage data, support communications, tax metadata, chargeback records, and unclaimed-property compliance records.
22.3 Third-Party Processors. RV MarketIQ may use third-party processors and service providers, including authentication providers, database providers, hosting providers, payment processors, tax-calculation providers, email providers, AI providers, storage providers, analytics providers, security providers, and unclaimed-property or compliance service providers. Current or contemplated providers include Clerk, Supabase, Stripe, Resend, OpenAI, AWS or S3-compatible storage providers, and other vendors.
22.4 Data Residency. RV MarketIQ's database or service providers may store data in the United States, including AWS us-east-1 or other regions selected by service providers. Data may be processed in jurisdictions where RV MarketIQ or its providers operate.
22.5 Retention Principles. RV MarketIQ retains data for as long as reasonably necessary for the purposes described in these Terms and the Privacy Policy, including providing services, maintaining accounts, preserving history during active access, administering Credits and quotas, preventing fraud, resolving disputes, complying with tax and unclaimed-property law, enforcing agreements, improving features, and maintaining records.
22.6 Recommended Retention Defaults. Unless RV MarketIQ adopts different periods in the Privacy Policy, checkout terms, feature disclosures, or internal retention schedule, the recommended default retention periods are:
Account profile data: while the account is active, plus thirty (30) days for processing, deletion workflows, security, and legal compliance.
DealGuard threads, messages, conversation turns, embeddings, summaries, and negotiation history: while the account or paid access is active, plus approximately thirty (30) days after expiration of the relevant access term, unless deleted earlier by the user or retained for legal, billing, security, abuse-prevention, unclaimed-property, or dispute reasons.
DealGuard Credit records, Credit Pack purchase records, Credit Batch records, Credit Balance records, expiration records, usage/redemption records, tax metadata, receipts, payment metadata, chargeback records, and unclaimed-property compliance records: as long as reasonably necessary for billing, tax, accounting, fraud prevention, chargebacks, customer support, unclaimed-property reporting, state dormancy periods, legal compliance, and audit defense.
Tow Capacity Estimator profiles, saved pairings, and related notes: while the account or paid access is active, plus thirty (30) days after expiration of the relevant access term, unless deleted earlier by the user or retained for legal, security, or dispute reasons.
Imported Listing drafts: while the account or paid access is active, plus thirty (30) days after expiration of the relevant access term.
Buyer Inquiry Lead records: twelve (12) months after the first to occur of Seller account expiration or Seller account deletion, subject to deletion requests, backup limitations, and legal holds.
Risk override logs: twelve (12) months after expiration of the relevant access term, subject to deletion requests and legal holds.
Archived Listing data: twelve (12) months after expiration of the relevant access term for user-specific archived views, unless retained in aggregated, de-identified, source-level, or legally necessary form.
Transactional and billing records: as required or reasonably necessary for tax, accounting, fraud prevention, chargeback, support, unclaimed-property compliance, and legal compliance.
22.7 Embeddings and Derived Data. RV MarketIQ may create embeddings, summaries, extracted phrases, classifications, and other derived data from Submitted Content. Where technically feasible, RV MarketIQ will use commercially reasonable efforts to delete or anonymize embeddings and derived data associated with a deleted parent thread, message, or account, except where retention is permitted or required by law.
22.8 Deletion Requests. You may request deletion of certain account data by using in-app controls, if available, or by contacting support@RVMarketIQ.com. RV MarketIQ will process requests according to applicable law and the Privacy Policy. RV MarketIQ may need to verify your identity before acting on a request.
22.9 Operational Limitations. Some data may not be fully deleted immediately because of backups, logs, legal holds, fraud-prevention records, tax records, billing records, Credit records, unclaimed-property records, dispute records, safety records, or copies already shared with third parties such as Sellers, Dealers, payment processors, AI providers, email providers, or compliance vendors.
22.10 California Privacy Rights. If California privacy law applies to RV MarketIQ or to your information, California residents may have rights to know, access, correct, delete, opt out of certain sharing or sales, limit use of sensitive personal information, and avoid discrimination for exercising rights. RV MarketIQ does not intend to sell personal information for money. De-identified Data is not intended to be treated as personal information when maintained and used in de-identified form.
22.11 California Purpose Limitation and Training. RV MarketIQ will use personal information for purposes disclosed in the Privacy Policy, these Terms, checkout terms, feature disclosures, or consent screens. RV MarketIQ will not intentionally use identifiable DealGuard submissions from California residents for generative AI training or fine-tuning without Optional Training Consent.
22.12 GDPR / International Privacy Rights. If GDPR or similar law applies, users may have rights to access, correct, delete, restrict, object to processing, portability, and lodge complaints. RV MarketIQ is U.S.-focused and may restrict access from jurisdictions where compliance obligations are disproportionate to the Platform's intended market.
22.13 Security. RV MarketIQ uses reasonable administrative, technical, and organizational measures designed to protect data. No system is perfectly secure. RV MarketIQ does not guarantee that unauthorized access, data loss, breach, outage, or cyberattack will never occur.
22.14 Dormant, Expired, or Credit-Bearing Accounts. RV MarketIQ may delete, anonymize, restrict, archive, or disable data associated with dormant, expired, abandoned, unpaid, or inactive accounts after notice where legally required. If an account has unused DealGuard Credits, RV MarketIQ may retain records and take actions reasonably necessary to honor Credits, display balances, send notices, resolve disputes, prevent fraud, comply with tax and unclaimed-property laws, or satisfy legal obligations.
23. Email Communications
23.1 Transactional Emails. RV MarketIQ may send transactional emails, including account notices, billing confirmations, access-expiration reminders, Buyer Inquiry messages, Seller notifications, security alerts, support messages, legal notices, and policy notices.
23.2 Expiration Reminders. RV MarketIQ may send an access-expiration reminder approximately seven (7) days before your paid access term ends. The reminder is a courtesy and does not extend your access term.
23.3 Marketing Emails. RV MarketIQ may send marketing emails if permitted by law and your communication preferences.
23.4 Unsubscribe. You may opt out of marketing emails by using the unsubscribe link or contacting support@RVMarketIQ.com. You may still receive transactional or legally required emails.
23.5 Email Delivery. RV MarketIQ is not responsible for failure of email delivery caused by spam filters, incorrect addresses, provider outages, user opt-out, blocked domains, or technical issues.
23.6 CAN-SPAM Information. RV MarketIQ’s physical mailing address for commercial email purposes is 14323 S. Outer 40 Rd., Ste. 204N, Chesterfield, MO 63017.
24. Intellectual Property
24.1 RV MarketIQ Property. The Platform, software, databases, models, workflows, user interfaces, designs, text, graphics, logos, source code, object code, algorithms, compilations, analytics, data structures, and documentation are owned by RV MarketIQ or its licensors and are protected by intellectual-property laws.
24.2 Limited License. Subject to these Terms, RV MarketIQ grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for lawful personal or authorized business purposes during the applicable access period.
24.3 Restrictions. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, scrape, harvest, benchmark, or create derivative works from the Platform except as expressly permitted by law or by written permission from RV MarketIQ.
24.4 Feedback. If you provide suggestions, ideas, feedback, or improvement requests, RV MarketIQ may use them without restriction or compensation, subject to the Privacy Policy.
24.5 No Rights in Third-Party Content. Third-party Listings, photos, descriptions, data, trademarks, and content remain subject to the rights of their respective owners.
25. DMCA and Copyright Complaints
25.1 Copyright Policy. RV MarketIQ respects intellectual-property rights and may remove or disable access to allegedly infringing material.
25.2 DMCA Notices. If you believe content on the Platform infringes your copyright, send a DMCA notice containing the information required by 17 U.S.C. § 512 to RV MarketIQ’s designated copyright contact:

25.3 DMCA Registration. Publication of DMCA contact information in these Terms is not a substitute for any legally required designation or registration with the U.S. Copyright Office. RV MarketIQ must maintain any required DMCA agent registration to the extent it seeks DMCA safe-harbor protection.
25.4 Counter-Notices. If your content was removed in response to a DMCA notice, you may submit a counter-notice satisfying 17 U.S.C. § 512.
25.5 Repeat Infringers. RV MarketIQ may terminate or restrict accounts of users who repeatedly infringe intellectual-property rights.
26. Third-Party Services and Links
26.1 Third-Party Services. The Platform may integrate with or link to third-party services, including payment processors, authentication providers, AI providers, listing sources, map providers, analytics tools, storage providers, email providers, and data providers.
26.2 Third-Party Terms. Third-party services are governed by their own terms and privacy policies. RV MarketIQ is not responsible for third-party services, data, outages, accuracy, pricing, security, or conduct.
26.3 No Endorsement. Links or integrations do not imply endorsement, sponsorship, affiliation, certification, or verification.
26.4 Availability. Third-party services may change, restrict, block, discontinue, rate-limit, or charge for access. RV MarketIQ may be unable to provide features that depend on third-party services.
27. Prohibited Uses
You may not, and may not assist others to:
27.1 use the Platform for illegal, fraudulent, deceptive, harmful, abusive, harassing, defamatory, discriminatory, or unsafe purposes;
27.2 impersonate any person, Seller, Dealer, buyer, attorney, finance company, escrow provider, transport provider, government agency, or RV MarketIQ representative;
27.3 submit false, misleading, stolen, unauthorized, infringing, confidential, private, or unlawful content;
27.4 post or promote Listings you do not have authority to sell or advertise;
27.5 use DealGuard outputs as definitive factual accusations against third parties;
27.6 use the Negotiation Agent to threaten, harass, deceive, defame, discriminate, or commit fraud;
27.7 use the Tow Capacity Estimator to make safety-critical decisions without independent verification;
27.8 upload recordings without legally required consent;
27.9 submit private, credentialed, confidential, non-public, or unauthorized URLs through import tools;
27.10 scrape, crawl, harvest, reverse engineer, benchmark, extract, or build datasets from the Platform without written permission;
27.11 bypass or attempt to bypass rate limits, access controls, authentication, billing gates, security controls, or usage limits;
27.12 interfere with Platform operation, including through denial-of-service attacks, spam, malicious code, automated abuse, or excessive requests;
27.13 use the Platform to collect, sell, rent, or misuse personal information;
27.14 violate intellectual-property, privacy, publicity, contract, consumer-protection, advertising, dealer, finance, recording, export-control, sanctions, or other laws;
27.15 use the Platform to provide competing services, train competing models, or reproduce Platform data or outputs at scale, except as expressly authorized by RV MarketIQ;
27.16 use a payment method without authorization, commit chargeback fraud, evade fees, evade credit limits, resell or transfer DealGuard Credits, pool Credits across accounts, or manipulate Credit Balances or Premium Daily Quota;
27.17 access the Platform if you are under eighteen (18); or
27.18 use the Platform in any manner RV MarketIQ reasonably determines creates legal, safety, security, privacy, operational, or reputational risk.
28. Content Moderation; Reporting; Platform Integrity
28.1 Moderation Rights. RV MarketIQ may review, remove, restrict, label, deprioritize, suspend, or refuse content, accounts, Listings, Dealer profiles, Buyer Inquiries, imports, or outputs for any reason, including suspected fraud, illegality, infringement, privacy risk, safety risk, misleading content, abuse, or violation of these Terms.
28.2 No Duty to Monitor. RV MarketIQ has no general duty to monitor user content, Listings, Seller communications, Dealer conduct, or third-party sources.
28.3 Reports. Users may report suspected fraud, inaccurate Listings, infringement, privacy issues, unsafe conduct, or policy violations to support@RVMarketIQ.com or through in-app reporting tools if available.
28.4 No Guarantee of Action. RV MarketIQ may investigate or decline to investigate reports in its discretion and does not guarantee any particular action, timeline, or outcome.
28.5 Third-Party Content. RV MarketIQ is not responsible for user-generated, Seller-generated, Dealer-generated, or third-party content. RV MarketIQ’s hosting, displaying, removing, labeling, or moderating third-party content does not make RV MarketIQ the author or guarantor of that content.
29. Legal Module; Legal Intelligence; No Legal Services
29.1 No Legal Services. RV MarketIQ is a marketplace-intelligence and analytics platform. It is not a law firm and does not provide legal services.
29.2 No Legal Advice. No Platform feature, including DealGuard, the Negotiation Agent, legal-intelligence features, case-analysis features, document-analysis features, or AI Outputs, provides legal advice.
29.3 No Attorney-Client Relationship. Use of the Platform does not create an attorney-client relationship, prospective-client relationship, engagement, retainer, fiduciary duty, legal consultation, or confidential attorney communication between you and RV MarketIQ, any owner or operator of RV MarketIQ, or any attorney associated with RV MarketIQ.
29.4 Licensed Attorney Disclaimer. Any status of any RV MarketIQ owner, employee, advisor, contractor, or operator as a licensed attorney does not change the Platform’s non-legal nature and does not create legal duties, privilege, confidentiality obligations, or professional representation.
29.5 No Privilege. Communications with the Platform, AI systems, support team, or RV MarketIQ personnel are not attorney-client privileged merely because they involve legal topics or because an attorney is associated with RV MarketIQ.
29.6 Do Not Submit Legal Client Confidential Information. Do not submit privileged, confidential, client, case, litigation, settlement, medical, or legal-work-product information unless a separate written agreement signed by RV MarketIQ expressly authorizes such submission and appropriate confidentiality and data-processing terms are in place.
29.7 Legal Module Acknowledgment. If RV MarketIQ offers a gated legal-intelligence, legal-analysis, or law-firm module, RV MarketIQ will require a separate no-legal-advice and no-attorney-client acknowledgment before access unless a separate written agreement signed by RV MarketIQ provides otherwise. Any such module remains subject to this Section 29 unless a separate written agreement signed by RV MarketIQ expressly states otherwise.
29.8 Consult a Lawyer. If you need legal advice, consult a licensed attorney in the relevant jurisdiction.
30. Warranty Disclaimer
30.1 As-Is and As-Available. The Platform, Listings, data, AI Outputs, DealGuard, Negotiation Agent, Tow Capacity Estimator, MarketIQ Value, VIN data, import tools, alerts, watchlists, dealer tools, and all related services are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise.
30.2 Disclaimed Warranties. To the maximum extent permitted by law, RV MarketIQ disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, availability, security, reliability, suitability, and quiet enjoyment.
30.3 No Warranty of Results. RV MarketIQ does not warrant that the Platform will detect scams, prevent fraud, produce accurate valuations, identify safe towing combinations, improve negotiations, find better deals, avoid losses, verify Listings, verify Sellers, or meet your expectations.
30.4 No Error-Free Operation. RV MarketIQ does not warrant that the Platform will be uninterrupted, error-free, secure, free of harmful code, compatible with your systems, or available at all times.
30.5 Third-Party Data. RV MarketIQ does not warrant third-party data, government data, Seller data, Dealer data, auction data, imported URL data, or AI-provider outputs.
30.6 Consumer Law. Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, disclaimers apply to the maximum extent permitted by law. Nothing in this Section waives nonwaivable rights under the Missouri Merchandising Practices Act, California consumer laws, or other applicable consumer-protection laws.
31. Assumption of Risk; Release of Liability for Negligence
31.1 Acknowledgment of Risk. You understand and agree that RV shopping, RV valuation, towing analysis, scam screening, negotiation, payment, title transfer, inspection, financing, transport, and off-platform transactions involve real risks, including financial loss, fraud, inaccurate information, unsafe towing, property damage, mechanical damage, bodily injury, and death.
31.2 Voluntary Use. You voluntarily choose to use the Platform with knowledge that AI Outputs, Listings, data sources, third-party communications, towing estimates, valuation estimates, and negotiation suggestions may be wrong, incomplete, outdated, or unsuitable.
31.3 EXPRESS RELEASE FOR NEGLIGENCE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND DISCHARGE RV MARKETIQ AND ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, LICENSORS, SUPPLIERS, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE PLATFORM, AI OUTPUTS, DEALGUARD, THE NEGOTIATION AGENT, THE TOW CAPACITY ESTIMATOR, MARKETIQ VALUE, LISTINGS, BUYER INQUIRIES, IMPORT TOOLS, UPLOADS, OR OFF-PLATFORM TRANSACTIONS, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE, FAULT, OR CARELESSNESS OF RV MARKETIQ OR ANY RELEASED PARTY.
31.4 Exceptions to Release. The release in this Section does not apply to the extent prohibited by law, including to liability that cannot legally be released for intentional misconduct, reckless conduct, or nonwaivable statutory rights. If a jurisdiction treats any category of heightened misconduct as nonwaivable, this Section applies only to the maximum extent permitted by that law.
31.5 Agreement Not to Sue. To the maximum extent permitted by law, you agree not to sue RV MarketIQ or released parties for claims released in this Section. This agreement does not prevent you from bringing claims that applicable law does not permit you to waive.
31.6 Conspicuousness. You acknowledge that this Section is intended to be conspicuous, clear, unambiguous, and part of the basis of the bargain for use of the Platform.
32. Limitation of Liability
32.1 Excluded Damages. To the maximum extent permitted by law, RV MarketIQ and its owners, officers, directors, members, managers, employees, contractors, agents, affiliates, service providers, licensors, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, punitive, enhanced, or lost-profit damages; lost revenue; lost savings; lost business; lost opportunity; lost data; loss of goodwill; fraud losses; transaction losses; towing losses; personal-property losses; travel expenses; inspection expenses; repair expenses; financing losses; or damages arising from reliance on the Platform, even if advised of the possibility of such damages.
32.2 Liability Cap. To the maximum extent permitted by law, RV MarketIQ’s total liability arising out of or relating to the Platform or these Terms will not exceed the greater of: (a) the amounts you paid RV MarketIQ for the specific Access Plan giving rise to the claim during the three (3) months before the event giving rise to liability; or (b) five hundred dollars ($500).
32.3 Per-Transaction Cap. For any claim arising from a specific RV, Listing, Seller, Dealer, transaction, negotiation, scam analysis, valuation, towing estimate, import, Buyer Inquiry, or AI Output, RV MarketIQ’s liability is capped as stated in Section 32.2 and does not include the purchase price, sale price, deposit, bid amount, repair cost, transport cost, towing damage, tax, title fee, financing amount, insurance amount, or other transaction-related amount.
32.4 AI and Data-Specific Limitations. To the maximum extent permitted by law, RV MarketIQ is not liable for missed scams, false positives, false negatives, inaccurate valuations, unsafe towing decisions, stale Listings, inaccurate VIN data, failed negotiations, generated-message errors, transcription errors, import errors, duplicate-detection errors, Seller misconduct, Dealer misconduct, or user reliance on AI Outputs.
32.5 Statutory Rights and Nonwaivable Remedies. Nothing in these Terms excludes or limits liability, damages, attorneys’ fees, punitive damages, equitable relief, or other remedies to the extent such limitation is prohibited by applicable law. Nothing in these Terms waives nonwaivable rights under the Missouri Merchandising Practices Act, California consumer-protection laws, privacy laws, or other applicable laws.
32.6 Basis of Bargain; Not a Penalty. The warranty disclaimers, risk allocations, releases, and liability limitations are essential parts of the bargain between you and RV MarketIQ. They allocate risk, are supported by consideration, and are not intended as a penalty. They apply even if a limited remedy fails of its essential purpose, except to the extent prohibited by law.
33. Indemnification
33.1 Your Indemnity. You agree to defend, indemnify, and hold harmless RV MarketIQ and its owners, officers, directors, members, managers, employees, contractors, agents, affiliates, service providers, licensors, and suppliers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:
your access to or use of the Platform;
your Submitted Content;
your Listings;
your Buyer Inquiries;
your use, sharing, editing, sending, publishing, or reliance on AI Outputs;
your towing decisions;
your transactions with Sellers, Buyers, Dealers, or third parties;
your submitted URLs;
your uploaded images, audio, PDFs, or screenshots;
your misuse of buyer contact information;
your violation of these Terms;
your violation of law;
your infringement or misappropriation of third-party rights; or
your fraud, misrepresentation, negligence, or misconduct.
33.2 Control of Defense. RV MarketIQ may assume control of the defense and settlement of any claim subject to indemnification. You may not settle any claim in a manner that imposes obligations on RV MarketIQ without RV MarketIQ’s prior written consent.
33.3 Consumer Law Limits. This indemnity applies to the maximum extent permitted by law and does not require consumers to indemnify RV MarketIQ for RV MarketIQ’s own unlawful conduct where such indemnity is prohibited.
34. Suspension and Termination
34.1 Suspension. RV MarketIQ may suspend, restrict, or terminate your access if RV MarketIQ reasonably believes that you violated these Terms, created legal or safety risk, submitted fraudulent information, misused personal information, engaged in abusive conduct, failed to pay, initiated improper chargebacks, misused DealGuard Credits, attempted to transfer or resell Credits, or used the Platform in a way that threatens security, operations, or other users.
34.2 Termination by You. You may stop using the Platform at any time. If you want to delete your account, use in-app controls if available or contact support@RVMarketIQ.com. Stopping use does not automatically delete all data, cancel all legal obligations, eliminate Credit-related records, or entitle you to a refund.
34.3 Effect of Termination or Expiration. Upon termination or expiration, your right to access paid features ends. RV MarketIQ may delete, archive, anonymize, or retain data as described in these Terms and the Privacy Policy. DealGuard Credits, Premium Daily Quota, and Credit-related records are also governed by Section 6A.
34.4 Purchased Credits on Termination. If your account is terminated for cause, suspended for fraud, closed because of chargeback abuse, or closed because of a material violation of these Terms, unused DealGuard Credits may be forfeited without refund to the maximum extent permitted by law. If RV MarketIQ terminates your account without cause while you hold purchased Credits, RV MarketIQ will use commercially reasonable efforts to provide a legally compliant remedy as described in Section 6A.18.
34.5 Survival. Sections concerning disclaimers, limitations of liability, releases, indemnification, intellectual property, privacy, data retention, payment obligations, taxes, Credit records, unclaimed-property compliance, prohibited uses, class action waiver, jury trial waiver, venue, attorneys' fees, and legal disclaimers survive expiration or termination.
35. Dispute Resolution; Informal Resolution; Missouri Venue; Class and Jury Waivers; Attorneys’ Fees
35.1 Please Contact Us First. Before filing a claim, you agree to contact RV MarketIQ at jhollingshead@hdtriallawyers.com and attempt in good faith to resolve the dispute informally. The notice must describe your claim, requested relief, and contact information.
35.2 Informal Resolution Period. The parties will attempt to resolve the dispute for thirty (30) days after RV MarketIQ receives your notice. Either party may seek urgent injunctive relief where necessary to prevent irreparable harm.
35.3 No Arbitration. These Terms do not require arbitration. Any prior draft, discussion, or platform policy suggesting mandatory arbitration is superseded by this V2 provision unless a separate written agreement signed by RV MarketIQ and you expressly requires arbitration.
35.4 Exclusive Federal-First Forum. To the maximum extent permitted by law, any action or proceeding arising out of or relating to these Terms, the Platform, any Access Plan, any AI Output, any Listing, any Buyer Inquiry, any Submitted Content, any data use, or any transaction analyzed or facilitated through the Platform must be filed exclusively as follows: (a) if a United States district court has subject-matter jurisdiction, in the United States District Court for the Eastern District of Missouri, Eastern Division; and (b) if no United States district court has subject-matter jurisdiction, in the Circuit Court of St. Louis County, Missouri.
35.5 Consent to Jurisdiction and Venue. Each party irrevocably consents to personal jurisdiction and venue in the courts identified in Section 35.4 and waives objections based on personal jurisdiction, improper venue, inconvenience, or forum non conveniens. No party waives any objection based on lack of subject-matter jurisdiction.
35.6 Removal Preserved. Nothing in these Terms prevents RV MarketIQ from removing an action to federal court where removal is permitted by law. Nothing in these Terms creates federal subject-matter jurisdiction where it does not otherwise exist.
35.7 Small Claims. Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court, subject to the forum provisions above unless applicable law requires a different forum.
35.8 Injunctive Relief. RV MarketIQ may seek temporary, preliminary, or permanent injunctive relief in any court of competent jurisdiction to address intellectual-property misuse, scraping, security abuse, unauthorized access, privacy misuse, confidentiality violations, platform abuse, or conduct that threatens the Platform or other users.
35.9 CLASS ACTION WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND RV MARKETIQ AGREE THAT ANY DISPUTE MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, REPRESENTATIVE, OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, PRIVATE ATTORNEY GENERAL, OR SIMILAR PROCEEDING. No court may consolidate claims or award relief to persons other than the individual claimant except to the extent required by law.
35.10 Preservation of Individual Remedies. The class action waiver does not waive your right to bring an individual claim, seek individual actual damages, seek individual statutory remedies, seek individual equitable relief, or seek individual attorneys’ fees where available under applicable law. It is intended to waive class, collective, consolidated, representative, and private-attorney-general procedures only to the maximum extent permitted by law.
35.11 JURY TRIAL WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND RV MARKETIQ KNOWINGLY, VOLUNTARILY, INTENTIONALLY, AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, CLAIM, COUNTERCLAIM, OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, ANY ACCESS PLAN, ANY AI OUTPUT, ANY LISTING, ANY BUYER INQUIRY, ANY SUBMITTED CONTENT, OR ANY TRANSACTION ANALYZED OR FACILITATED THROUGH THE PLATFORM.
35.12 California Jury-Waiver Carveout. The jury trial waiver does not apply to California consumers to the extent a predispute contractual jury waiver is unenforceable under applicable California law.
35.13 Attorneys’ Fees and Litigation Expenses. Subject to nonwaivable statutory rights and remedies, the prevailing party in any action arising out of or relating to these Terms or the Platform is entitled to recover reasonable attorneys’ fees, expert fees, court costs, and litigation expenses. If each party prevails on one or more claims or defenses, the court may determine the substantially prevailing party or allocate, apportion, offset, reduce, or deny fees on a claim-by-claim basis according to the parties’ relative success, applicable law, and equitable considerations.
35.14 Statutory Fee Savings Clause. Nothing in Section 35.13 limits any nonwaivable statutory right to attorneys’ fees, costs, punitive damages, or equitable relief, including any right available under the Missouri Merchandising Practices Act or other applicable consumer-protection law. Nothing in Section 35.13 requires a consumer to pay RV MarketIQ’s fees for unsuccessfully asserting a non-frivolous statutory consumer-protection claim where fee shifting against the consumer is prohibited by law.
35.15 Frivolous or Bad-Faith Claims. Nothing in these Terms limits any party’s right to seek fees, costs, sanctions, or other relief for frivolous, vexatious, bad-faith, abusive, or sanctionable conduct where permitted by law.
35.16 Severability. If a court determines that any part of this Section is invalid or unenforceable, the invalid or unenforceable part will be severed or limited to the minimum extent necessary, and the rest of this Section will remain enforceable to the maximum extent permitted by law.
36. Governing Law
36.1 Missouri Law. These Terms and all non-federal claims arising out of or relating to these Terms, the Platform, any Access Plan, any AI Output, any Listing, any Buyer Inquiry, any Submitted Content, or any transaction analyzed or facilitated through the Platform are governed by the laws of the State of Missouri, without regard to conflict-of-law rules.
36.2 Federal Claims. Federal law governs federal claims and federal procedural issues where applicable. Missouri law governs contract interpretation and non-federal claims to the maximum extent permitted by law.
36.3 Consumer Protection Savings Clause. Nothing in these Terms limits nonwaivable consumer rights under the laws of your state of residence. If a state’s law does not permit Missouri law, Missouri venue, a class waiver, a jury waiver, a liability limitation, a release, or a fee provision to apply to a particular claim or user, the affected provision applies only to the maximum extent permitted by that law.
36.4 California Rider. For California residents, these Terms apply together with any California-specific disclosures in the Privacy Policy, checkout flow, or feature screens. RV MarketIQ does not intend to enroll California residents in an automatic renewal or continuous service plan unless RV MarketIQ separately presents legally sufficient automatic-renewal terms and obtains legally sufficient affirmative consent. RV MarketIQ does not intend to require California consumers to waive nonwaivable rights under California consumer-protection, privacy, automatic-renewal, data-security, or similar laws.
37. Changes to These Terms
37.1 Updates. RV MarketIQ may modify these Terms from time to time. The updated Terms will be posted on the Platform with a new effective date.
37.2 Material Changes. If RV MarketIQ makes material changes, RV MarketIQ may provide notice by email, in-app notice, banner, checkout disclosure, or other reasonable method. Continued use after the effective date constitutes acceptance of the updated Terms, except where affirmative consent is required by law.
37.3 No Retroactive Material Reduction Without Notice. Material changes that substantially reduce your rights or materially increase your obligations during an active paid fixed-term access period or with respect to already-purchased DealGuard Credits will not apply to that paid period or those Credits unless required by law, necessary for security, necessary to prevent fraud or abuse, necessary to comply with payment, tax, unclaimed-property, or prepaid-access rules, or accepted by you.
38. Electronic Communications and Notices
38.1 Electronic Communications. You consent to receive communications electronically, including notices, disclosures, agreements, billing messages, expiration reminders, support messages, and other communications.
38.2 Legal Notices to RV MarketIQ. Legal notices to RV MarketIQ must be sent to jhollingshead@hdtriallawyers.com and 14323 S. Outer 40 Rd., Ste. 204N, Chesterfield, MO 63017, unless these Terms or law require a different method.
38.3 Notices to You. RV MarketIQ may send notices to the email associated with your account, by in-app notification, by posting on the Platform, or by other reasonable method.
38.4 Delivery. Notices are deemed given when sent or posted, except where law requires different timing.
39. Miscellaneous
39.1 Entire Agreement. These Terms, incorporated policies, and applicable checkout or plan terms are the entire agreement between you and RV MarketIQ regarding the Platform.
39.2 Severability. If any provision is invalid or unenforceable, the remainder remains in effect to the maximum extent permitted by law.
39.3 No Waiver. RV MarketIQ’s failure to enforce a provision is not a waiver.
39.4 Assignment. You may not assign these Terms without RV MarketIQ’s prior written consent. RV MarketIQ may assign these Terms in connection with a merger, acquisition, reorganization, asset sale, financing, change of control, or by operation of law.
39.5 Force Majeure. RV MarketIQ is not liable for delay or failure caused by events beyond its reasonable control, including outages, cyberattacks, provider failures, natural disasters, labor disputes, government actions, war, terrorism, pandemics, or utility failures.
39.6 No Third-Party Beneficiaries. These Terms do not create third-party beneficiary rights except for RV MarketIQ’s affiliates, service providers, licensors, and indemnified parties where applicable.
39.7 Headings. Headings are for convenience only and do not limit the Terms.
39.8 Interpretation. Words such as “including” mean “including without limitation.” The singular includes the plural and vice versa.
39.9 No Shortened Limitation Period. These Terms do not shorten any applicable statute of limitations. Claims must be brought within the time allowed by applicable law.
